Terms of Use

The short version: Departd is a scheduling assistant that provides estimated departure and wake-up times based on calendar events, traffic, and weather data. These estimates are provided as helpful suggestions only. You are responsible for your own time management, and we strongly recommend always setting a backup alarm for critical events.
1. Acceptance of Terms
By downloading, installing, or using Departd ("the app"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.
2. Description of Service
Departd is a scheduling assistance application that calculates suggested wake-up times, departure times, and travel buffers based on your calendar events, real-time traffic data, weather conditions, and your personal preparation preferences. The app monitors conditions overnight and during the day and may adjust its suggestions based on changing conditions.
3. Important Disclaimers
SCHEDULING ESTIMATES ONLY: All wake-up times, departure times, travel durations, weather buffers, and arrival predictions provided by Departd are estimates only and should not be relied upon as the sole means of time management for critical events. These estimates are based on third-party data sources (traffic APIs, weather services, mapping providers) that may be inaccurate, delayed, or unavailable.
ALWAYS SET A BACKUP ALARM: For time-critical events including but not limited to flights, medical appointments, job interviews, legal proceedings, and important meetings, you should always set an independent backup alarm using your device's built-in clock application or a physical alarm clock. Departd is designed to assist your time management, not replace your personal responsibility for punctuality.
NO GUARANTEE OF NOTIFICATION DELIVERY: Departd relies on the iOS notification system and background processing capabilities, which are managed by Apple's operating system. iOS may delay, throttle, or suppress notifications and background tasks based on system conditions, battery state, device usage patterns, and other factors outside our control. We cannot guarantee that alarms, departure alerts, or triage notifications will be delivered at the exact scheduled time or at all.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHRISTOPHER RADTKE AND DEPARTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Missed flights, trains, buses, or other transportation
- Late arrival at appointments, meetings, interviews, or events
- Financial losses resulting from missed or late attendance at any event
- Employment consequences resulting from tardiness or absence
- Any damages arising from inaccurate travel time estimates, weather data, or traffic information
- Any damages arising from failure of alarm notifications to deliver on time
- Any damages arising from iOS background processing limitations that affect alarm adjustment or traffic monitoring
This limitation applies regardless of the legal theory on which the claim is based, whether you have been advised of the possibility of such damages, and whether or not the limited remedies provided herein fail of their essential purpose.
5. Assumption of Risk
You acknowledge and agree that:
- Departd provides scheduling suggestions, not guarantees of on-time arrival
- Traffic conditions, weather, and other variables can change rapidly and unpredictably
- Third-party data sources (mapping services, weather APIs) may contain errors or be temporarily unavailable
- iOS system limitations may affect background processing, notification delivery, and location monitoring
- You retain full personal responsibility for managing your time and ensuring you arrive at events on schedule
- You will use Departd as a supplementary tool alongside, not as a replacement for, your own time management judgment
6. Subscription Terms
Departd offers optional paid subscription tiers (Pro and Family) with enhanced features. Subscriptions are billed through Apple's App Store and are subject to Apple's subscription terms. You may cancel your subscription at any time through your Apple ID settings. Refunds are handled by Apple in accordance with their refund policies.
Free tier features may change over time. We reserve the right to modify which features are included in each tier, though we will not remove core functionality from active paid subscriptions during their current billing period.
7. Intellectual Property
Departd, its design, features, and underlying technology are the intellectual property of Christopher Radtke. Certain aspects of the technology are the subject of a pending patent application with the United States Patent and Trademark Office. You may not reverse engineer, decompile, or disassemble the app, or attempt to derive its source code.
8. User Conduct
You agree not to:
- Use Departd while operating a vehicle (configure the app before driving)
- Rely on Departd as your sole alarm for safety-critical or emergency situations
- Attempt to circumvent subscription restrictions or manipulate the app's functionality
- Use the app in any manner that violates applicable laws or regulations
9. Modifications to the App and Terms
We reserve the right to modify, update, or discontinue Departd or any of its features at any time. We may also update these Terms of Use from time to time. Material changes will be communicated through the app or by updating the "Last Updated" date above. Your continued use of the app after changes constitutes acceptance of the revised terms.
10. Termination
You may stop using Departd and delete the app at any time. We reserve the right to suspend or terminate access to the app if you violate these Terms of Use.
11. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.
12. Severability
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
